A terrible case has come to light at Medanta Hospital in Gurugram, with an air hostess with a digital rape despite being on a ventilator in ICU. The incident was revealed when the victim lodged her complaint at Sadar police station on 14 April after coming to her senses. The police immediately took action and arrested the accused Deepak Kumar. Deepak is a resident of Muzaffarpur in Bihar and was recently served as an ICU technician at Medanta Hospital after obtaining a degree in Operation Theater Technology.
What is digital rape?
Digital rape is a serious sexual offense, in which fingers or an object is entered in a private part of a person without consent. In this, the word ‘digital’ does not mean internet or digital technology, but it shows the use of physical organs. The crime was included in the category of rape under Section 375-376 of the Indian Penal Code (IPC) after the 2012 Nirbhaya incident. Subsequently, it has also been considered a serious offense under the Code of Justice of India (BNS).
Legal provisions and punishment
There is a provision of strict punishment for this, considering digital rape as a serious offense in India. Under Section 375-376 of the first IPC, the convict could have been sentenced to at least 7 years, which could have increased to 10 years or life imprisonment in some cases. If the victim is a minor, then the punishment under the Poxo Act is even more hard, including a jail or life imprisonment of 10 to 20 years. Now it is placed in the category of rape under India’s new law. If someone does such an act without consent, he can be sentenced to 10 years of jail or life imprisonment.
Social awareness requirement
Digital rape cases are increasing in India, but there is a lack of awareness about this crime, especially in rural areas. Often suffering women remain silent due to social pressure and do not talk openly about this crime. Experts say that it is very important to educate people about this crime, so that women and society can raise their voice against it and action can be taken against criminals.
Digital rape is a serious offense and provides for strict punishment against it, but it can be difficult to stop this crime completely without awareness and education.
