‘Innocent’ jailed and inspector fined Rs 1 lakh… Why did the Supreme Court put a stay on this order?:

A big news has come from the Supreme Court in a very sensitive and discussed case of Madhya Pradesh. This case is related to the kidnapping and murder of two little girls, in which question marks were raised on the role of the police. Madhya Pradesh High Court had made strict remarks on the investigating officer (police inspector) in this case and imposed a fine of Rs 1 lakh on him. But now the Supreme Court on Wednesday on the order of that fine ‘Stay’ Has been installed.

Let us understand in simple language what the whole matter was, why the High Court was angry and what the Supreme Court said now.

What decision did the Supreme Court give?
The matter is in the Supreme Court before Justice K.V. Vishwanathan and Justice P.B. Reached in front of Varale’s back. The petition was filed on behalf of Police Inspector Chain Singh Uike. After hearing both the sides, the Supreme Court said that till further orders, the decision of the High Court in which a fine of Rs 1 lakh was imposed on the inspector will be stayed. This means that at present the police officer will not have to pay the fine.

Lawyer’s argument- “Our side was not even heard”
Advocate Ashwini Dubey stood in the court on behalf of the Inspector. He made a very valid point. He said that the High Court directly gave the verdict and imposed the fine, but the police officer against whom the allegations were made was not even given a chance to present his side (Natural Justice). It is not right to impose such a huge fine and make such harsh remarks without hearing the explanation. Accepting this argument, the Supreme Court has given relief.

Flashback: What happened? (whole story)
This incident is heart-wrenching.

  • 4 April 2022: Bodies of two little girls (aged 3 and 5 years) were found near a dam in Balaghat district.
  • Police Theory: The police, in their investigation, said that the girls’ uncle was the murderer and arrested him. The police claimed that the murder was done after kidnapping.
  • Decision of the lower court: On January 31, 2024, the Sessions Court accepted the police investigation as true and sentenced the accused uncle to death.

High Court’s U-turn and rebuke to the police
When the matter reached Madhya Pradesh High Court, the whole game changed there. The judges found that the police had committed gross negligence in the investigation. The High Court said that the investigating officer acted with malicious intent and played with the evidence. The court also said that due to wrong investigation by the police, an innocent person had to languish in jail unnecessarily for three and a half years.
As a result, the High Court not only honorably acquitted the accused but also imposed a fine of Rs 1 lakh on the investigating officer.

Now what next?
At present, the police inspector has got a big relief. Now the Supreme Court will see whether the comments made by the High Court on the police were correct or not and whether there were really such big irregularities in the investigation. But one thing is certain, this case is now becoming an example in this fight between justice and khaki.
