Supreme Court News: The Supreme Court has advised doctors across the country not to write medicines from a particular brand. The Supreme Court made oral comments in a case that the legal order for doctors to prescribe only generic medicines would be resolved by pharmaceutical companies to write excessive or irrational drugs and to emphasize high -priced branded drugs.

A division bench of Justice Vikram Nath, Justice Sanjay Karol and Justice Sandeep Mehta heard a petition. In the petition, pharmaceutical companies have been accused of arbitrariness. In such a situation, the Supreme Court said that if it is made mandatory for pharmaceutical companies across the country, then it can improve a lot.

The petition stated that pharmaceutical companies are paying bribes to grab do doctors business, prescribe excessive or irrational drugs and promote high -priced or expensive brand drugs.

In this context, the Supreme Court has been requested to issue such instructions that until the same code of pharmaceutical marketing is implemented, the judiciary can set guidelines to control and regulate illegal marketing practices by the pharmaceutical companies. The petition stated that alternatively, the Supreme Court may make the existing law binding with such amendments and familiarity, as it is appropriate, which will be followed by all competent courts under Articles 32, 141, 142 and 144 of the Constitution. In this case, a notice was sent to the Central Government in March 2022.

Initially, the Supreme Court said that the case may take some time and it will be kept for hearing after holidays. However, the petitioner’s counsel told the Supreme Court that the opposing party has filed a counter affidavit, stating that a high -level committee has been formed. However, there is no information about what the committee has suggested as recommendations. At this point, Justice Mehta questioned whether there is any legal order that doctors should prescribe only generic medicines rather than a particular brand or company drugs. The lawyer replied that there is no legal order in it. It is only a voluntary code that doctors should prescribe generic medicines. In this context, the Rajasthan High Court has given a similar decision earlier. The Supreme Court has postponed the next hearing of the case till 24 July.
