Prayagraj, 09 September (HS). The Allahabad High Court has refused to intervene and dismissed the petitions against the contract allocation process for supply of sal sleepers and sal aging for the pontoon bridges to be built during the Maha Kumbh Mela.

The court said that the Public Works Department officials have not done any arbitrary, discriminatory or malicious action in the tender process. The entire procedure has been followed as per the rules. This order has been given by the division bench of Justice Shekhar B Saraf and Justice Manjeev Shukla on the petition of Dynamic Infracon Pvt Ltd and M/s Bengal Wood and Allied Products.

The petitioner said that PWD Prayagraj issued a tender for the supply of sal sleepers and sal aging to be used in pontoon bridges in Maha Kumbh Mela. The petitioner placed a bid of Rs 2,26,900 per cubic meter. A total of 12 companies filled the tender. Out of which 11 companies including the petitioner were found eligible. But when the tender was opened on 15 June 24, 5 companies got the contract. In which the bid of Rs 1,58,000 per cubic meter was accepted. The petitioner raised questions about the stock of three companies Dhormanath Traders, Shraddha Timber Store and Basant Timber Mart. He said that they do not have the prescribed stock. Which is a violation of the tender conditions.

The opposition said that the purchase committee had verified the stock from the Assistant Forest Range Chhattisgarh. The stock of the company that got the contract was found to be 1,13,197 cubic meters. There is no procedural flaw. The court said that the tender process was as per the rules and refused to interfere.
