Seema Haider, who came into the discussion with ‘Pubji’ love, is once again in the headlines. Seema Haider, who came to India illegally from Pakistan, gave birth to Sachin Meena’s first daughter. However, a dispute has arisen over the citizenship of this girl.
The border came to India without visa-passport
In May 2023, Seema Hyder entered India without a visa-passport via Nepal. She quietly started living with her lover Sachin Meena in Rabupura village of Greater Noida. When the case came to light, both were arrested. Later, after getting bail, Seema married Sachin and started living in her house.
However, the case of illegal entry of border into India is still pending in court. Now legal diligences are also coming out regarding the citizenship of her daughter.
Will Seema’s daughter be an Indian citizen?
According to the Indian Citizenship Act:
- If both parents are Indian citizens, then the child will be Indian by birth.
- If one of the parents is Indian and the other is a foreigner, the child will be an Indian citizen, provided foreign parents have come to India in a legitimate manner.
Border fault problem became a problem
- Since Seema Hyder illegally came to India and did not have a valid visa and passport, her daughter could not get Indian citizenship from birth.
- If the border had come to India with valid documents, her daughter would have got Indian citizenship without any problem.
Opinion of legal experts
Will Seema’s daughter get citizenship or not?
According to Supreme Court senior advocate Rudra Vikram Singh:
*”Seema Haider and Sachin Meena’s child cannot get Indian citizenship until it is proved that the border came legally to India.” Under Section 3 C (ii) of the Citizenship Act, one of the parents should be an Indian citizen and the other is not illegally living in India.
Sachin’s lawyer claims
Sachin Meena’s lawyer AP Singh claims that Seema married Sachin in Nepal even before coming to India. He argues that Seema should get Indian citizenship on this basis.
However, the matter is still pending in court and the court will give a final verdict on it.
Petition sent to President
Advocate AP Singh also filed a petition for Seema Haider’s citizenship before the President. If this petition is accepted, Seema can get Indian citizenship, which will also solve the case of his daughter’s citizenship.
What will happen next?
- His daughter cannot become an Indian citizen until Seema Hyder’s legal decision on citizenship.
- If the government particularly gives citizenship to the border, then his daughter can also get this right.
- If the court rejects the border claims, his daughter will be unable to get Indian citizenship.
