A petition was filed against the statement made against the Indian Army during the 2022 visit to India. After this, a court in Lucknow issued summons to him. The Allahabad High Court has dismissed the petition filed by Leader of Opposition in the Lok Sabha against that order by Rahul Gandhi. It is considered a big shock for Rahul Gandhi.
Justice Subhash Vidyarthi dismissed the petition on the basis of merit. Additional Chief Judicial Magistrate Alok Verma had directed Gandhi to appear for hearing on March 24 in the defamation case filed against him. This complaint was filed by advocate Vivek Tiwari on behalf of Uday Shankar Srivastava, former director of Border Roads Organization, whose post is equivalent to Colonel in the army. Tiwari has alleged that Gandhi’s statement on December 16, 2022 on December 9, 2022 regarding the clashes between Indian and Chinese soldiers was derogatory and defamable towards Indian military forces.
Rahul Gandhi had criticized the government, saying, “Chinese soldiers are killing Indian Army soldiers in Arunachal Pradesh.” Several petitions have been filed against Gandhi by political rivals and others in various courts across the country. In January this year, the Supreme Court had stayed the criminal defamation proceedings against Gandhi on calling the Union Home Minister and former Bharatiya Janata Party (BJP) president Amit Shah accused of murder.
The case began after BJP leader Naveen Jha filed a complaint against Gandhi. Gandhi was accused of criticizing the BJP by giving a speech on 18 March 2018 and accusing Shah of murder. Recently, the Supreme Court reprimanded Gandhi for his statement that Hindutva thinker Vinayak Damodar Savarkar was a partner of the British and received pension from the British.
PM Modi’s blunt on black money: real owners will be exposed
A bench of Justice Dipankar Dutta and Justice Manmohan said that Gandhi’s statements against freedom fighters were irresponsible and the court will take action itself if he makes similar statements. However, the bench had banned the summons issued by a magistrate court in connection with his statements in the criminal case launched by a lawyer for controversial statements.
