News India Live, Digital Desk: State government: The three -tier panchayat elections to be held in Uttarakhand are currently banned. The Nainital High Court, while giving an important verdict, has stayed the entire process of panchayat elections in the state with immediate effect. This ban has been imposed after the petitions filed for the reservation of seats in the election.
What is the whole controversy?
This matter is related to reservation of panchayat seats. The government issued an order (mandate) on March 11, 2024, on the basis of which the reservation of seats was to be decided. But this order was challenged in the High Court.
Petitioners, including Darshan Lal Sharma and others of Haridwar District Panchayat, have alleged that the government has for reservation ‘Chakranukram’ (rotation) The rule is not followed properly.
What is the Rotation Rules?
This is a system in which the reservation of seats varies in one order. That is, the seat which was reserved for one class (eg – Scheduled Caste, OBC or woman) last time should be for another class or general. The petitioners say that the government has broken this bicycle or order and has arbitrarily implemented reservation.
A single bench of Justice Rakesh Thapliyal heard the case. Taking seriously the arguments of the petitioners, he has banned the government’s order of March 11 and the entire election process on the basis of it till the next hearing.
This directly means that until the High Court does not pronounce its final decision on this reservation dispute, Panchayat elections will not be held in Uttarakhand. Now the government will have to present its case before the court in this matter.
