Supreme Court’s big decision on check bounce cases, now relief will be given, court will be lower!

News India Live, Digital Desk:There is a relief news for those who transact with checks. Sometimes the check bounces and then starts real trouble-there is loss of money, along with the court-court rounds. But now the Supreme Court has said one such thing about check bounce cases that can reduce this run.

Why did the Supreme Court worry?

Actually, millions of check bounce cases are stuck in courts across the country. These cases not only take precious time of courts but also cause delay in hearing of other important cases. The Supreme Court has expressed concern over this, saying that they should try to settle these cases as soon as possible, especially when the two sides are ready to compromise between themselves.

Give priority to agreement – Court advice

Recently, while hearing a case of check bounce, a bench of two judges of the Supreme Court gave the same advice. It happened that there was a case of check bounce between two parties, but later they reached a compromise. The party that had given the check had also paid more than ₹ 5 lakh to the other party.

When the matter reached the Supreme Court, the court noticed that when the two sides had reached an agreement and the money has been paid, there is no point in prolonging the case. The court immediately canceled the punishment of the person. The law also provides that mutual consent can be compromised in cases of check bounce.

What are the instructions for the rest of the courts?

Citing this case, the Supreme Court has given the same advice to all other lower courts of the country. The court has said that if the complainant and the accused (check -giving) in the case of check bounce are compromised, the courts should accept the agreement and abolish the case immediately. It should not be pulled unnecessarily long.

The Supreme Court believes that the courts should focus on settling the case through agreement, rather than emphasizing the punishment in such cases. This will not only save the time of the courts and they will be able to pay attention to other cases, but the people associated with check bounce cases will also get rid of the court’s rounds quickly.

This decision is good news for millions of people who are entangled in check bounce cases and want to resolve the matter with mutual consent.
