News India Live, Digital Desk: Big Setback for Trump: The US Appeal Court has given a major blow to former President Donald Trump, calling his attempt to end his birthright citizenship as unconstitutional. The ninth American Circuit Court of appeals upheld the lower court verdict that stopped the policy from being implemented. This decision has come at a time when US elections are close and immigration remains a major issue.
The Donald Trump administration had tried to end the automatic citizenship of children of illegal immigrants in the US based on birth. He argued that it could be changed through the Executive Order or Administrative Rules of the President, there is no need for any constitutional amendment. However, the first section of the fourteenth amendment of the US Constitution clearly states that all individuals born in the United States or naturally citizenship are citizens of America. The main objective of this amendment was to provide citizenship to former slaves after the civil war.
This special legal battle was not related to the mainland, America, but was associated with claims of birthright in American regions such as Guam and American Samoa. Nevertheless, this decision of the court has far -reaching implications and it imposes a clear constitutional seal on birthright across the country.
Immigrant pro -immocratious groups and civil rights advocates have continuously maintained the argument that birthright is a constitutional guarantee and can only be replaced by a constitutional amendment and not by the order of a president. The decision is being seen as a major victory of the US Constitution and civil rights, which has once again clarified the limits of the President’s power. This shows that the person sitting in the highest position also has to work within the purview of the Constitution.
