Mumbai: The Bombay High Court has ruled that all proceedings, including court hearings in SC and ST Act cases, must be video recorded. Sadhna Jadhav left it to the Division Bench to decide how to put the words of the proceedings into practice. The issue came up during the hearing of the bail plea filed by Payal Tadvi against three doctors Hema Ahuja, Bhakti Mehre and Ankita Khandelwal, her junior, on charges of abetment of suicide in 2019.
The division bench on Wednesday said that video recording of the proceedings in such cases is necessary, even if the hearing is held in open court, adding that accountability towards the public will also be kept in mind. It will be ensured that the victim and witnesses are adequately heard.
In many cases victims are not aware of the legal process and its implications. However, the court said that not all courts in the state have the facility of video recording which it is the duty of the government to provide. The court said that in cases where the personal liberty of the accused is in danger, the hearing may continue without video recording until the facility is available.
