New Delhi: The Central Government introduced a bill to amend the Waqf Act in the Lok Sabha, on which there was a heated debate between the ruling party and the opposition. The opposition India coalition opposed the bill, while the NDA parties supported the bill. The bill was introduced by Union Minister Kiren Rijiju, which was discussed from 12 noon to midnight. At the end of the debate, the Bill was passed in the Lok Sabha and is likely to be introduced in the Rajya Sabha on Thursday. During the debate, Union Home Minister Amit Shah, while defending the bill, clarified, saying, “I want to tell the Muslims of the country that not a single non-Muslim will be included in your Waqf.” Muslims are being misled by claiming that their religious matters are being intervened.
In defense of the bill, Amit Shah said that thousands of acres of land in the name of Waqf was given to the thieves, a strong law was needed to stop this theft in the name of Waqf. One of the largest debates is whether non-Muslims will be included in the Waqf. I would like to clarify the issue that non-Muslims will not be included in the Waqf. There will be no non-Muslim among the people who manage religious institutions. Any non-Muslim will only see whether the money given for Waqf law and donation is being implemented properly. Non-Muslims will only see whether the administration is actually running according to the law. They will monitor whether the funds are being used properly for the development of the poor.
Amit Shah further clarified that no one is worried about the people whose land was taken outside the judicial powers of the court. How can the decision of a government or institution be out of the jurisdiction of the court? Where will those whose land have been taken away will go? Now he has been given the right to appeal in the court. The report will be presented, the balance sheet will be introduced, the entire audit will be done by retired CAG. Why will anyone run away from this transparency? Any decision of Waqf Board or Council can be challenged in court. If this law had been amended in 2013, we would not have to amend now.
The Home Minister said that an MP is saying that we will not accept this amendment in the Waqf Act, I want to tell them that this is the law of Parliament and every citizen should accept it. We have not tampered with Waqf, we have done this research for Waqf Board and Waqf Council. The functioning of these two is administrative, the Waqf Board should not be associated with religion. We are not touching Mutavalli. While BJP MP Sambit Patra claimed that the number of pending applications in relation to Waqf land has increased manifold and all the applicants are Muslims, meaning that it is Muslims who have raised questions about the Waqf administration. The new law will provide justice to such victims Muslims.
While opposing the bill, Congress MP KC Venugopal said that the government is bringing non -Muslims in the Waqf Board, Muslims are not included in any other religion trust, there is such a provision in the Vaishno Devi Temple Act, Muslims or Christians do not have the right to vote in any temple. The Waqf Bill has violated the Equality Act, today you are targeting the Muslim community, tomorrow you will target Christians and then Sikhs.

Now this bill will be introduced in the Rajya Sabha, after getting the approval in the Rajya Sabha, it will be sent to the President, the bill will be converted into law as soon as the approval of the President and later a notification will be issued by the government to implement it in the whole country, which may take some time.

Responding to Akhilesh’s sarcasm, Shah said, “Akhilesh ji has said something smiling, so I will also smile and answer.” Shah pointed to the opposition MPs, saying, “All these parties have to choose their national president from five members of their family, while we have to follow a process and choose the chairman of 12-13 crore members, so it takes time.” Shah, taking a sarcasm at Akhilesh, said, “I am telling you that you will remain the party president for 25 years and no one can take your place.”
What are the main provisions of the Waqf Act?
– The Waqf Act (Amendment) Bill 2025 aims to change the Waqf Act, 1995. The first change in this is that the name of the Act has been changed to integrated Waqf Management, Empowerment, Efficiency and Development Act, 1995.
– Waqf Tribunal will have three members instead of two. Under the amended structure, each tribunal will include a District Magistrate, a joint secretary level officer of the state government and an expert in Muslim law and jurisprudence.
– All information related to Waqf properties should be uploaded on the portal specified within six months of the implementation of the law. Any new Waqf property registration should be presented to the concerned Waqf Board only through this portal.
– Officers can directly appeal to the concerned High Court within 90 days of receiving the order of the tribunal.
-Non-Muslim members will be included in the Central and State Waqf Board. The board will have at least non-Muslim members. Of course, there will be no non-Muslim in a committee interfering in religious matters. Non-Muslims will take care of the administration of the property donated only under the Waqf law. Non-Muslims will keep an eye on the fact that the property is being used for the purpose for which it was donated, and is it being administered according to the law.
-Non-Muslim CEO can be appointed in Waqf Board. State governments will have to appoint at least two non-Muslim members in the Waqf Board. The officer who is part of the Waqf Board of the state government should be a joint secretary level officer dealing with Waqf cases.
– According to the Waqf Act (Amendment) Bill 2025, the trusts created by Muslims under any law will not be considered as Waqf, which will ensure complete control over the trusts.
According to the new bill, only those Muslims will be able to dedicate their property to Waqf who have been following Islam for at least five years. The same rule was before the year 2013 and has been re -implemented.
– Muslim women will also be included in institutions like Central Waqf Council, State Waqf Board and Waqf Tribunal.
– The Center will have the right to appoint three MPs in the Waqf Board. Two out of these three MPs will be from Lok Sabha and one from Rajya Sabha. It is not necessary that this MP is a Muslim.
Under the amended bill, the Central Government will have the right to make rules regarding registration and publication of Waqf accounts and publication of Waqf Board.
– The Central Government will have the power to order the accounts of Waqf by the Comptroller and Auditor General (CAG) or a nominated officer to audit the accounts of Waqf.
– The officer above the collector level will inspect the government properties claimed as Waqf. In case of dispute, a senior government official will take a final decision whether the property is of Waqf or the government. Currently, the Waqf Tribunal determines who is the owner of the property.
