“What was so hurry?” – When other judges expressed surprise at a decision of the High Court itself

In the world of justice and court, everything is usually carried out by laws and regulations. But recently, something happened in the Allahabad High Court, which is also surprised to hear the big law experts. The matter is so unique that the judges of the same court raised questions on the decision and manner of their own judge.

What is this whole matter?

This story is associated with a sabotage of Ghaziabad Development Authority i.e. GDA. The GDA started running bulldozers to remove illegal occupation on government land. One of those whose seats were being removed, one man (petitioner) immediately reached the High Court.

Now this is from here that there is an extraordinary turn in the story. On the appeal of the petitioner, a single judge (bench of a judge) of the High Court heard in the night itself. And not only the hearing, but also ordered the GDA to stop the sabotage action immediately without hearing it.

When the double bench raised questions

When GDA came to know about this order, he reached a double bench (two -judge bench) against this decision. When the double bench saw the whole matter and read the order of a single bench, he was also surprised.

The questions he raised was very serious. They asked, ,After all, what was so hurry to stop the sabotage? “The judges surprised the fact that GDA, which was a main party in this case, gave a unilateral decision without giving him a chance to present his side?

The double bench strictly said that it seems as if the judicial process has been misused. He immediately banned the decision given by the single bench in that haste. Now the entire hearing of the case will be held on 22 October, in which both sides will be heard.

This case is a great example of how important it is to listen to every aspect in the process of justice and any hasty can be against the principles of justice.
